Dealing with someone gambling at work and more…

My employee keeps going on gambling sites at work. I’m worried he has an addiction. What can I do?

Is it impacting his work? If so, hold a meeting with him and explain that he must spend time at work carrying out his duties and not gambling.

You can offer support by suggesting he seeks help or introduce an Employee Assistance Programme (also called an EAP), which offers confidential counselling for both work and personal issues.

But remember, even though encouraging your employee to get help is a good idea, he may not want to talk about it.

Can I claim back the statutory sick pay or statutory maternity pay I give to employers?

Not for statutory sick pay. Your business must pay it all, making it important you manage sick employees to help them return to work.

For statutory maternity pay, you can usually reclaim at least 92% of the maternity pay you give to your staff.

Some smaller businesses can even claim back 103%, depending on the amount of National Insurance Contributions.

Are there different working time rules for younger workers?

Workers under the age of 18 have different rules about how long they can work for to give them more protection.

You have to give workers aged 16-17 two days off per week, a daily rest break of 12 hours, and a rest break of 30 minutes if they work for more than 4.5 hours.

Young workers can’t work at night except in very limited circumstances, and there are extra limits and rules for children aged 13-16 to help protect their education.
